ARTICLE 4(1) DIRECTION AROUND HARROGATE STRAY
I am writing on behalf of
Harrogate Friends of the Earth with regard to the consultation on the proposed
Harrogate Stray Article 4 Direction, which we believe is unnecessary and
inappropriate.No need has been shown for this Article 4 Direction. There is currently no problem of unsightly solar panels fronting the Stray. Your officers seem to be saying that an A4D is needed now in case it becomes a problem.
An A4D inconveniences all residents bordering the Stray
who want panels, whether aesthetically pleasing or not, requiring them to go
through the planning application process, pay for drawings etc. It would put a
completely unwarranted obstacle in their way when what is needed is to give every
encouragement to people to invest in renewable energy, as well as in energy
efficiency.
Changes in the rules last year (GPDO, part 40) mean that planning permission is no longer normally required to install panels on residential properties in conservation areas, subject to some sensible conditions. We believe officers concern was sparked by an application for panels in Raglan Street, which was refused. As the property is commercial and not residential it is not affected by the changes and the owners would still need planning permission just as before.
In due course, if the council should have reasonable
concern that this change is causing a problem, it could then consider an A4D,
but now is not the time. Please do not extend the current temporary A4D.
